1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of www.upgraderemodeling.com (the "Site"), our text messaging program, and your communications with Upgrade Remodeling LLC ("Upgrade Remodeling," "we," "us," or "our"). By using the Site, submitting a form, or opting in to receive messages from us, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, please do not use the Site or opt in to our messaging program.

2. Services, Estimates, and Contracts

Upgrade Remodeling provides home remodeling services, including bathroom, kitchen, flooring, exterior, and window replacement work, to homeowners in Virginia.

  • Consultations and estimates. Requesting a free consultation or estimate does not obligate you to buy anything. Any estimate, quote, or pricing shared on the Site, by phone, or by text is for informational purposes only.
  • Written contract controls. No project is binding until you and Upgrade Remodeling sign a written contract. The signed contract governs the scope, price, schedule, warranty, and cancellation rights for your project, and it takes priority over these Terms if the two conflict.
  • Content on the Site. Photos, project examples, promotions, and descriptions on the Site are for illustration. Products, pricing, availability, and offers may change without notice and may vary by location.

3. Text Messaging Terms (SMS, MMS, and RCS)

Program name. Upgrade Remodeling Customer Updates.

Program description. By opting in, you agree to receive text messages from Upgrade Remodeling at the mobile number you provide. Messages may be sent as SMS, MMS, or RCS (Rich Communication Services) depending on your device and carrier. Messages may include responses to quote, estimate, or service inquiries; real-time answers to questions about our services and pricing; appointment scheduling, confirmations, and reminders; details on what to expect during your visit; project updates; feedback requests; and follow-ups.

How you opt in. You opt in by submitting a form on our Site, at a retail or event location, or by phone, and checking or agreeing to the text messaging consent, or by texting us first. Consent to receive text messages is not a condition of any purchase.

Message frequency. Message frequency varies. You can expect to receive about 5 to 10 messages per month.

Costs. Msg & data rates may apply. Contact your wireless provider with questions about your text or data plan.

Opt out (STOP). You can cancel at any time. Reply STOP to any message. You will receive one final message confirming you have been unsubscribed, and you will receive no further messages from us. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. To rejoin, sign up again as you did the first time or reply START.

Carrier liability. Carriers are not liable for any delayed or undelivered messages.

Mobile information sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.

4. Use of the Site

  • Accurate information. You agree to provide accurate contact and property information when you submit a form or request a consultation, and to use only a phone number you own or are authorized to use.
  • Permitted use. You may use the Site for personal, non-commercial purposes. You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or submit false or misleading information.
  • Intellectual property. The Site's content, including text, photos, logos, graphics, and design, is owned by or licensed to Upgrade Remodeling and protected by applicable law. You may not copy, reproduce, or distribute it without our written permission.
  • Third-party links. The Site may link to third-party websites, such as review platforms, financing partners, or social media. We do not control and are not responsible for their content, terms, or privacy practices.

5. Disclaimers and Limitation of Liability

Disclaimer. The Site and our messaging program are provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties, express or implied, about the Site's accuracy, availability, or fitness for a particular purpose. Warranties for remodeling work are provided only in your signed contract.

Limitation of liability. To the fullest extent permitted by law, Upgrade Remodeling is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or messaging program, including delayed or undelivered messages. This section does not limit any rights you have under your signed contract or under law that cannot be waived.

Indemnification. You agree to indemnify and hold harmless Upgrade Remodeling and its owners, employees, and contractors from claims arising from your misuse of the Site or your violation of these Terms.

6. Privacy, Governing Law, and Changes

Privacy. Our Privacy Policy explains how we collect, use, and protect your information, including your mobile number and messaging consent.

Governing law. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Virginia.

Changes. We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last Modified" date above will be updated. Continued use of the Site or messaging program after changes are posted means you accept the updated Terms.
